AFFILIATE TERMS OF SERVICE
The WIBG LLC ("STREAMALLOVER.COM" or "Company" or "we") affiliate program (the "Affiliate Program") is designed to help you generate income in exchange for referring new hosting clients to STREAMALLOVER.COM. These Affiliate Program Terms (the "Affiliate Agreement") are a contract between STREAMALLOVER.COM and you (the "Affiliate" or "you"), and it governs the terms and conditions of your participation in the Affiliate Program.
BY REGISTERING AS AN AFFILIATE YOU ARE AGREEING TO THE TERMS AND CONDITIONS. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, YOU ARE NOT PERMITTED TO PARTICIPATE IN THE AFFILIATE PROGRAM.
As a STREAMALLOVER.COM affiliate, you may accrue a one-time referral fee for each purchase of a hosting account that you refer to STREAMALLOVER.COM that meets the definition of a "Qualified Purchase" and the requirements set forth herein. A "Qualified Purchase" is the purchase of STREAMALLOVER.COM's hosting services by a new and unique customer who: (i) clicks on an affiliate tracking link, (ii) completes the signup process within ninety (90) days of clicking on the affiliate tracking link, (iii) maintains an active account with STREAMALLOVER.COM for a minimum of ninety (90) days; and (iv) did not transfer from a STREAMALLOVER.COM partner or related company.
Affiliate accounts must be active at the time of the referral. No referral fee will accrue for sales that occurred before your participation in the Affiliate Program.
In order for affiliate referrals to accrue and be eligible for your first referral fee payment, you must (i) reach a minimum threshold of USD$100 (the "Minimum Threshold") in referral fees within twelve (12) months of the first Qualified Purchase you refer to STREAMALLOVER.COM; and (ii) provide STREAMALLOVER.COM with all relevant tax and address documentation, as further discussed herein. The Minimum Threshold only applies to the first payment issued to you under the Affiliate Program. All subsequent referral fees or credits for Qualified Purchases will accrue and only become payable once you have provided all relevant tax and address documentation.
You are solely responsible for keeping all information up to date including postal and email addresses, name, payment information, tax information and any other personal information that will impact the ability to issue a valid payment. Each Affiliate is required to submit an accurate and up to date W-8/W-9 tax form. If you have not submitted a tax form, we have provided some of the most commonly required tax forms under the "Tax Form" tab located in the "Settings" tab in the affiliate portal for your convenience. If we do not receive the necessary tax or payment information from you within ninety (90) days of a Qualified Purchase that would otherwise trigger a referral fee, such referral fee shall not accrue and no resulting referral fee will be owed with respect to such Qualified Purchase. Your tax information is required to be on file in order for your referral fees to accrue and become payable.
Affiliates are solely responsible for ensuring that all payee information is accurate and up to date in the affiliate system. STREAMALLOVER.COM is not responsible for any lost or stolen payments.
Missing or untracked affiliate referrals must be reported during the then current referral period (either between the 1st and the 15th of the month or between the 16th and the end of the month) and will be credited to your account at our sole discretion, provided that such credit has accrued pursuant to the terms contained herein. Referrals that are not reported during the then current referral period will not be credited to your account.
The affiliate referral fees are determined approximately 45 days after the end of the month in which the Qualified Purchase is recorded. Payments are then processed and sent to Affiliates between the 16th of the month and the last day of the month. EXAMPLE: A Qualified Purchase recorded in January will be sent to the Affiliate between March 16th and March 31st.
Payments are sent using the PayPal mass payment system. STREAMALLOVER.COM pays for the transaction fee associated with the mass payment system. You are required to supply a PayPal address to receive payments. If you would prefer to receive payments by check, you must notify STREAMALLOVER.COM and payments will be sent to the address you provide. Please note that payments by check take up to an additional thirty (30) days to arrive. For larger affiliates with balances of over USD$10,000 per month, STREAMALLOVER.COM offers a wire transfer option. To update your payment information, please contact the affiliate department.
In the event that STREAMALLOVER.COM reissues any payment, a USD$35 charge will apply and be deducted from the Affiliate's earnings.
Affiliates are responsible for making sure they are able to accept payments. Please ensure that your bank or PayPal account can accept payments from US-based companies.
Affiliates are responsible for any and all fees, taxes, exchange rates, surcharges and other expenses incurred in order to receive their referral fees. Please check with your local banking institution or PayPal to find out if any of these apply for your account.
Because of the high frequency of credit card fraud and cancellation rates, STREAMALLOVER.COM reserves the right to hold referral fees for up to two (2) additional months for verification. At STREAMALLOVER.COM's sole discretion, we reserve the right to cancel referral fees in the event that we are unable to collect funds, the order is fraudulent, the customer cancels within the first ninety (90) days, or if we learn that the referral fee was earned improperly for any other reason.
If a referred customer initially purchases a hosting package with a term of at least one (1) year and then downgrades their hosting package to a term of less than one (1) year within one (1) year of their initial purchase, the applicable referral fees paid to the Affiliate will be reversed and deducted from future earnings.
Referred customers that issue a chargeback or are found to be fraudulent (e.g. false information, fake/stolen credit cards, selling counterfeit goods etc.), as determined in STREAMALLOVER.COM's sole discretion, will be reversed regardless of the amount of time that has passed since the signup occurred.
Customers using non-standard rates (rates not available through the Affiliate Program) are not eligible for affiliate referral fees, as determined at STREAMALLOVER.COM's sole discretion. Non-standard rates include but are not limited to: sales, promotions, email offers, prepaid accounts and discounted pricing offered for educational, government, non-profit or charity organizations.
Affiliate Restrictions and Responsibilities:
Affiliates MAY NOT offer cash back, rewards or other incentives to drive traffic/sales via their affiliate tracking links.
Affiliates MAY NOT use traffic that is generated by pay to click, pay to read, banner exchanges, click exchanges, CPV advertising, pop-up/under, SPAM, purchased traffic or similar methods.
Affiliates MAY NOT use cookie stuffing techniques that set the tracking cookie without the user actually clicking on the referral link (for example a 1x1 pixel iframe).
Affiliates MAY NOT bid on or use STREAMALLOVER.COM's trademark, trademark +, or misspelled keywords for the purpose of PPC on Internet search engines (Google, Yahoo, MSN, Ask etc.).
Affiliates MAY NOT use STREAMALLOVER.COM's trademark, trademark +, or misspelled keywords in their domain names.
Affiliates are responsible for ensuring their tracking code is working properly before sending traffic to STREAMALLOVER.COM's servers. Any modification to the links is the sole responsibility of the Affiliate. Referral fees may not be paid for tracking errors caused by editing, masking, redirecting or tampering with affiliate links, as determined in STREAMALLOVER.COM's sole discretion.
Affiliates MAY NOT use redirected pages and links to send a user to our site. For example, you may not have a PPC link on a search engine that redirects the user to our site.
Domain forwarding is prohibited -- you may not purchase a domain and set it to forward directly to our site using your affiliate link.
Affiliates MAY NOT copy STREAMALLOVER.COM's website or any portions thereof, including, without limitation, any of STREAMALLOVER.COM's trademarks or other intellectual property, and display them on their own site or subdomain or use them in any way without STREAMALLOVER.COM's prior express written permission.
Affiliates MAY NOT engage in the advertisement of business-opportunity sites or use marketing practices that attract fraudulent or short-term customers (customers with low retention and renewal rates) which shall be determined at our sole discretion.
FTC Disclosure Policy:
It is our intent to treat our customers fairly. Accordingly, we require all STREAMALLOVER.COM affiliates to comply fully with all applicable laws, regulations and guidelines concerning advertising and marketing, including without limitation, the Federal Trade Commission (FTC) Endorsement Guides (See the FTC Endorsement Guide for more information.), which require that material connections between advertisers and endorsers be disclosed. This means that all affiliate websites (e.g. directories, review/rating sites, blogs and other websites) and any email or collateral that provide an endorsement or assessment of STREAMALLOVER.COM, must prominently disclose the fact that you may receive compensation for referring customers to STREAMALLOVER.COM.

It does not purport to provide legal advice and it does not guarantee that you will be in compliance with FTC regulations if you follow the suggestions presented. You are advised to seek and obtain your own legal advice on how these rules apply to your website or other promotional activities for which you receive compensation.
At our sole discretion, we reserve the right to withhold referral fees and/or terminate the affiliate relationship for your failure to comply with STREAMALLOVER.COM's FTC disclosure policy or with any other applicable regulations or guidelines, as determined by STREAMALLOVER.COM at our sole discretion.
Affiliate accounts may be deactivated at any time without warning or notice at our sole discretion. Any affiliate who violates STREAMALLOVER.COM's Terms of Service, including without limitation, these Affiliate Program Terms, or any applicable law is subject to having their affiliate account deactivated immediately, and any and all accrued, but not yet received, referral fees will be forfeited.
In our sole discretion, any false or misleading advertising or suspected fraudulent activity associated with your affiliate account will result in immediate deactivation.
Affiliate accounts generating a large number of fraudulent accounts, as determined in our sole discretion, will be deactivated.
Affiliates may not resell hosting. All referred customers must provide their own payment method and contact information to be a Qualified Purchase. If STREAMALLOVER.COM determines in its sole discretion that an Affiliate is reselling hosting, the affiliate account will be immediately deactivated.
If you would like to discontinue your participation in the Affiliate Program at any time, simply remove your affiliate links from your website and no longer promote them. For accounting purposes, our systems will retain your account and personal information.
STREAMALLOVER.COM may change any of the terms and conditions in this Affiliate Agreement, in whole or in part, at any time at STREAMALLOVER.COM's sole discretion. Unless otherwise provided, such modifications will take effect when posted on STREAMALLOVER.COM's website and apply to all referral fees that have not yet accrued. If we make any significant changes to this Affiliate Agreement, we will post a notice on this page for at least thirty (30) days after the changes are posted and will indicate at the bottom of this Affiliate Agreement the date of the last revision. In addition, STREAMALLOVER.COM will use reasonable efforts to provide you with seven (7) days advance notice of any changes that materially impact your participation in the Affiliate Program. Unless otherwise provided, your continued participation in the Affiliate Program following our posting of any modification on our website will constitute your acceptance of all changes. If you do not agree to any such changes, your sole and exclusive remedy is to deactivate your account as described above.
STREAMALLOVER.COM maintains a zero tolerance policy for use of its network or services in any manner associated with the transmission, distribution or delivery of any bulk e-mail, including unsolicited bulk or unsolicited commercial e-mail, or the sending, assisting, or commissioning the transmission of commercial e-mail that does not comply with the U.S. CAN-SPAM Act of 2003 ("SPAM").
It is your obligation to ensure that e-mail sent by you, or on your behalf, does not violate this law. We assume SPAM complaints are valid unless we are provided with credible information to the contrary. You may not use any of our services or network to send SPAM. In addition, e-mail sent, or caused to be sent, to or through our network or services may not:
Use or contain invalid or forged headers
Use or contain invalid or non-existent domain names
Employ any technique to otherwise misrepresent, hide or obscure any information in identifying the point of origin or the transmission path
Use other means of deceptive addressing
Use a third party's Internet domain name, or be relayed from or through a third party's equipment, without permission of the third party
Contain false or misleading information in the subject line or otherwise contain false or misleading content
Fail to comply with additional technical standards described below
Otherwise violate STREAMALLOVER.COM's User Agreement, AUP and other Terms of Service
STREAMALLOVER.COM does not authorize the harvesting, mining or collection of e-mail addresses or other information from or through its network. STREAMALLOVER.COM does not permit or authorize others to use its network or services to collect, compile or obtain any information about its Subscribers or users, including but not limited to Subscriber e-mail addresses, which are STREAMALLOVER.COM's confidential and proprietary information. Use of our network or services is also subject to our User Agreement, AUP and other Terms of Service.
STREAMALLOVER.COM does not permit or authorize any attempt to use its network or services in a manner that could damage, disable, overburden or impair any aspect of any of our services, or that could interfere with any other party's use and enjoyment of any STREAMALLOVER.COM product or service.
We monitor for SPAM all traffic to and from our servers. Customers suspected of using STREAMALLOVER.COM's products and services for the purpose of sending SPAM will be investigated. We assume SPAM complaints are valid unless we are provided with credible information to the contrary. It is STREAMALLOVER.COM's policy to immediately suspend, terminate and/or cancel any offending Web site or account sending SPAM.
Subscribers may be asked to produce records that verify that explicit affirmative permission was obtained from a recipient before a mailing was sent. STREAMALLOVER.COM may consider the lack of such proof of explicit affirmative permission of a questionable mailing.
Subscribers are prohibited from maintaining open mail relays on their servers. Ignorance of the presence or operation of an open mail relay is not and will not be considered an acceptable excuse for its (the open mail relay) operation.
Subscribers are prohibited from providing services for Web sites that have been included in SPAM, including, but not limited to hosting Web site(s), or providing DNS services or Web site redirect services.
It is a violation of this Policy to commission a third party to send e-mail that is in violation of this policy or of applicable law, even if that third-party does not use STREAMALLOVER.COM systems, networks or resources. E-mail not in compliance with this policy - regardless of source - which contains any reference to a Web site hosted by us or contains any reference or link to a network or system of STREAMALLOVER.COM is prohibited.
If STREAMALLOVER.COM believes that unauthorized or improper use is being made of our network, or any product or service, it may, without notice, take such action as it, in its sole discretion, deems appropriate, including blocking messages from a particular internet domain, mail server or IP address. STREAMALLOVER.COM may immediately suspend, terminate and/or cancel any account on any product or service which it determines, in its sole discretion, is transmitting or is otherwise connected with any e-mail that violates this policy.
STREAMALLOVER.COM reserves the right to suspend, terminate and/or cancel permanently any and all services provided to a Subscriber without any notification. In addition to any and all other rights hereunder or otherwise, if a Subscriber is in violation of any term or condition of this SPAM Policy, the Acceptable Use Policy, User Agreement or uses of our services to disrupt or, in STREAMALLOVER.COM's sole judgment, which could disrupt STREAMALLOVER.COM's business operations, STREAMALLOVER.COM reserves the right to charge such Customer an administrative fee equal to $100.00 per each piece of SPAM sent.

Nothing in this policy is intended to grant any right to transmit or send e-mail to, or through, our network or services. Failure to enforce this policy in every instance does not amount to a waiver of STREAMALLOVER.COM's rights.
Unauthorized use of STREAMALLOVER.COM's network in connection with the transmission of unsolicited e-mail, including the transmission of e-mail in violation of this policy, may result in civil and criminal penalties against the sender and those assisting the sender, including those provided by the Computer Fraud and Abuse Act (18 U.S.C. §1030, et seq.) and other state and federal laws.
Ownership Changes and Disputes
Access and Control Policy.
When a new account or domain, as applicable, is registered with or transferred to STREAMALLOVER.COM or with one of its affiliates, the process requires and results in the creation of the following within the records of STREAMALLOVER.COM, in association with said new account or domain: i) Name of person registering; ii) email address; iii) user name; iv) password; and, v) associated payment information, such as Visa, Mastercard, etc., Credit Card Number & name thereon, etc. If a person contacts STREAMALLOVER.COM and claims that he or she is entitled to access to an account, website, or domain registered with STREAMALLOVER.COM or its affiliate but is without access (for any reason such as but not limited to forgotten password or forgotten user name, data loss or corruption on personal computer, improperly locked out, and so forth), STREAMALLOVER.COM will give access to the person who acceptably evidences he or she has substantially all of: i) name of the person who originally registered; ii) email address of the person who originally registered; iii) the user name of the person who originally registered, if possible; iv) the associated payment information of the person who registered, such as Visa, Mastercard, etc., Credit Card Number & name thereon, etc. (mandatory); and, v) a photo identification evidencing she or he is the rightful possessor and user of said credit card or payment medium (mandatory). Otherwise, STREAMALLOVER.COM will not give access and control to a claimant unless STREAMALLOVER.COM is served with a valid order of a court, agency, or appropriate Internet controlling entity such as Internet Corporation for Assigned Names and Numbers ("ICANN"), requiring STREAMALLOVER.COM to give such access and control to said claimant or unless there is submitted to STREAMALLOVER.COM at legal@STREAMALLOVER.COM.com a written statement duly signed by the person who originally registered said account which statement is duly notarized, and in which said originally registering person confirms that said claimant is entitled to access and control of the account, together with a written notarized statement duly signed by claimant which confirms claimant is entitled to access and control of said account, website and/or domain and has read and agreed to these Terms of Service. Subscriber acknowledges and accepts that the foregoing access and control policies and procedures are the only way that notice(s) can be given and changes can be effected regarding said access and/or control; and, further, that any other changes made directly by Subscriber or by others within the online records of STREAMALLOVER.COM or of its affiliates shall not be deemed effective to give notice to STREAMALLOVER.COM or its affiliates of any changes in said access or control. Subscriber acknowledges and accepts said access and control policy and procedure, agrees not to bring any claim in the form of a lawsuit or otherwise against STREAMALLOVER.COM arising out of its following said policy and procedure, agrees immediately to dismiss any claim so brought, and hereby releases STREAMALLOVER.COM from all liability and all claims for damages or any other liability whatsoever that may arise out of STREAMALLOVER.COM's following said policy and procedure.
Transfer of Ownership.
STREAMALLOVER.COM is not responsible to determine ownership of websites hosted by, accounts opened with, or domains registered with STREAMALLOVER.COM or its affiliates. By accessing STREAMALLOVER.COM's system, registering, or using any of the services provided by STREAMALLOVER.COM, the Subscriber, or any other person so accessing, registering or using, hereby represents and warrants that the information provided in connection with said registration, including as well information concerning ownership of websites, domains, and accounts, is true, accurate, and complete in each material detail. Any disputes arising regarding the ownership of any account, website, or domain hosted by, opened with, or registered with STREAMALLOVER.COM or any of its affiliates are subject to the terms and conditions of this section of these Terms. STREAMALLOVER.COM will recognize a change of ownership of account(s) with, of websites hosted by, and/or of domains registered with STREAMALLOVER.COM or its affiliates only in the event that at least one of the following occur: i) there is received by the Compliance Manager ( legal@STREAMALLOVER.COM.com) a written statement (in a form acceptable to STREAMALLOVER.COM or applicable affiliate) containing the notarized signature of the original owner of the account, website, and/or domain, as applicable, confirming that ownership of the website, domain, and/or account, as applicable, has been transferred to a person (claimant) claiming to own said website, domain and/or account, as applicable, along with a written statement containing the notarized signature of the claimant confirming that she or he has acquired said ownership, has read and agrees to be bound by these Terms of Service; or, ii) STREAMALLOVER.COM is served with a valid order of a court, agency, or appropriate internet controlling entity such as Internet Corporation for Assigned Names and Numbers ("ICANN"), requiring STREAMALLOVER.COM (or affiliate) to transfer such ownership to said claimant. Subscriber acknowledges and accepts that the foregoing policies and procedures regarding transfer of ownership are the only way that notice(s) can be given and changes can be effected regarding said transfer of ownership within STREAMALLOVER.COM; and, further, that any other changes made directly by Subscriber or by others within the online records of STREAMALLOVER.COM or of its affiliates shall not be deemed effective to give notice to STREAMALLOVER.COM or its affiliates of any changes in said ownership.
Disputing Site or Account Ownership.
Disputes sometimes arise between or among multiple persons claiming ownership of or rights in a site hosted by STREAMALLOVER.COM or in an associated STREAMALLOVER.COM account. STREAMALLOVER.COM is not obligated to resolve any such disputes. If multiple persons are claiming ownership of or rights in a site hosted by STREAMALLOVER.COM or in an associated STREAMALLOVER.COM account, and, in STREAMALLOVER.COM's sole judgment, there is not certainty as to the ownership of or rights in said site or account, then STREAMALLOVER.COM will, to the extent of its knowledge and ability, notify said persons of the dispute and demand that said persons promptly, conclusively, and finally resolve the dispute in a manner which makes clear who the owner(s) and/or interest holder(s) is/are and in a manner which relieves STREAMALLOVER.COM of all liability or obligations concerning the dispute. If the disputing persons fail so to resolve the dispute within what STREAMALLOVER.COM, in its sole judgment, deems to be a reasonable time, then STREAMALLOVER.COM, at its option and without any obligation to do so, may, in accordance with and subject to the laws of the State of Utah, file an interpleader action in a court of competent jurisdiction within the State of Utah for the purpose of allowing the contending persons to resolve said dispute and to reach certainty regarding ownership of or rights in said site and/or account. The person or persons conclusively and finally determined by the interpleader action to be the rightful owner(s) or interest holder(s) of said site and/or associated account shall be obligated to reimburse STREAMALLOVER.COM for all of its expenses relative to said interpleader action including without limit all its court costs and reasonable attorney fees. All amounts owed to STREAMALLOVER.COM under this section shall be deemed due and payable immediately upon thirty (30) days after judgment or settlement is reached.
Notification of Transfer of Hosting Account Ownership.
Pursuant to Paragraph 2 above, the form found here may be used to notify STREAMALLOVER.COM of a change in ownership of a hosting account. Please note that any changes to the owner and/or billing information stored in the account control panel must be changed by the Transferor or the Transferee. STREAMALLOVER.COM will not be liable for any inability to access the account due to a failure to release access information. Filing this form with STREAMALLOVER.COM does not guarantee any changes. STREAMALLOVER.COM reserves the right to accept or reject the request for any reason in its sole and absolute discretion.
